Psychosocial evaluation of an adult experiencing incapacity

If your loved one is experiencing cognitive decline or a mental health crisis impacting their ability to care for themselves and their property and you are concerned they are at risk of exploitation or harm due to their vulnerability, you may be considering seeking some kind of legal protection to help them. Temporary representation, tutorship and the homologation of a protection mandate may be possibilities proposed to you. For each of these possibilities a psychosocial assessment by a registered social worker is required.

What do i do?

As professional social worker, I will meet with you and the person who needs protection as well as with concerned family members and friends and review pertinent documents to assess the presence of incapacity and its impact. My observations and analysis will be documented in an official assessment that is provided to a notary or a judge who will review the whole file before making a final decision.

For the purposes of homologating a mandate or instituting a tutorship we consider incapacity to be when a person no longer has the intellectual and cognitive capacity to care for themselves or manage their property.

Along with a medical evaluation from a doctor, psychosocial assessments are what determine a person’s incapacity and need for representation. These assessments focus on the person’s ability to take care of themselves and their property. They also address the need for them to be represented by another person in exercising their civil rights.
